The file is an image of a sand castle on Boracay Island, the Philippines, dated March 2016, and it's design is likely over the threshold of originality. @JWilz12345: I think sand castles can be regarded as "sculptures made by sand", and we'll need more information on Filipino threshold of originality to determine the status of File:I love Boracay.jpg, as that sand castle only consists of various characters, regards.廣九直通車 (talk) 12:34, 1 November 2020 (UTC)Reply[reply]
@廣九直通車: regretably, there is no mention of Filipino TOO at Commons:Copyright rules by territory/Philippines, and unfortunately there are no real life case rulings applicable for the works at (g) clause in our copyright law ("Works of drawing, painting, architecture, sculpture, engraving, lithography or other works of art; models or designs for works of art"). TOO can a point of contention in the Philippines, I admit, but much of us (here in the Philippines) always ignore the concept of TOO in terms of freedom of panorama, given the fact that there is, sadly, no freedom of panorama in our country. A recent development on Philippine FOP is that IPOPHL is considering FOP as one of the possible insertions or amendments for the ongoing review of the copyright law. For TOO, I admit I'm  Unsure, with no references to find that there is recognized TOO with respect to copyrighted artworks in the Philippines. It seems that this situation is analogous to Commons:Deletion requests/Files uploaded by Judgefloro#Files uploaded by Judgefloro (talk · contribs) 5. And by the way, once we established that that sand castle in this image exceeds TOO, Section 172.2 of the Intellectual Property Code provides that it is eligible for copyright protection regardless of mode or form of expression.廣九直通車 (talk) 05:12, 3 November 2020 (UTC)Reply[reply]
Update @廣九直通車: see w:Wikipedia talk:Tambayan Philippines#Some points from the dialogue for the main points of the dialogue last Feb. 10. Threshold of originality concept was not addressed, however, though it has been established that ideas are not copyrighted, but expressions of ideas are.
